Finally Some Common Sense! Florida Judges Rule Mask Mandates Are Unconstitutional

This little tidbit should have been receiving far more coverage but let’s be honest here….we expected that. Attorney Jeff Childers has been able to strike a major blow for brave patriots everywhere and he deserves to be commended for it. This story takes place in Alachua County, Florida.

This county also happens to be home to Gainesville, which is where the University of Florida is located. Justin Green, owner of a plant nursery, retained Childers as a legal representative. When Alachua County commissioners decided that they were going to pass an order that required all employees and customers in Alachua to wear masks when they frequented businesses, Green filed suit.

While Green lost the case initially, he did not allow that to break his stride. He filed an appeal and kept on pushing for justice. Childers filed the appeal on his behalf and the Alachua Chronicle has more about the ruling that has been handed down from the Judges of the First District:

“Governmental mask mandates in the 32 counties in the First District of Florida must now be presumed to be unconstitutional after yesterday’s ruling by the First District Court of Appeals (1st DCA) on a lawsuit brought by business owner Justin Green against Alachua County.

The lawsuit was originally filed on May 8, 2020, only days after Robert “Hutch” Hutchinson, then-Chair of the Alachua County Commission, instituted a county-wide mask mandate. Eighth Judicial Circuit Judge Donna Keim denied a request for an emergency injunction on May 21.”

Unless there is a case that we are currently not aware of, this would appear to be the first time that a mask mandate has been ruled to be unconstitutional in our country. We hope that this ruling is the first of many, as many American patriots are looking to return to normalcy during the waning moments of the pandemic. The full ruling is definitely worth reading more about.

Jeff Childers also took the time to speak out about the victory with Howie Carr, which is also well worth watching. At long last, we are finally getting the results that we deserve and we are beyond happy about it. These mandates were never lawful and that’s why Trump always pushed back against them.

People were mad when he wasn’t willing to talk badly about the protesters who just wanted the right to make their own common-sense decisions. No one wanted to argue about the virus or whether it was killing people. These are not arguments that were conducive at the moment and they are not conducive now.

The American people need to be able to make decisions without having to look over their shoulders every two seconds. This is all that anyone wanted. Did any conservative ever say that people didn’t need to be wearing masks at all? No, of course they did not. It was never about forcing anyone to do anything that they did not want to do. That’s lost on the far left, though. All they know how to do is boss people around.

They are sure to be livid over the lifting of mask mandates because they wanted the pandemic to go on for as long as possible. Now that courts are starting to agree with those who want them lifted, we cannot wait to see all of the fighting that ensues. We are willing to bet that this will not be the first or last time that we talk about a verdict of this nature this summer.

This summer is sure to have its fair share of debates but at least the protests have finally started to die down. We would not be surprised if the continued attempts at forcing mask mandates will cause the next round. At least there is one judge in the state of Florida who sees through all of this and is willing to do something about it. Kudos to this state for leading the way, as always!
